New Delhi: The Bombay High Court has upheld the life imprisonment on Thursday of 11 convicts in the Bilkis Bano Murder and rape case in 2002 during anti -Muslim violence and had refused death penalty on the demand of Central Bureau of Investigation.
The Court has also convicted six people for tampering with evidence in the riot case.
As there was demand by CBI to give death penalty to all the 11men by the court rejected the appeal.
The bench of justice VK Tahilramani and Mridula Bhatkar also dismisses the defence argument that Bilkis testimony was 'Bogus' and 'full of contradictions'.
Family of Bilki Bano was attacked by a mob at randhik pur village near Ahemdabad during the post- Godhra riots on March 3 2002.
Eight members were killed from her family in the riot including four women and four children where six went missing.
And as Bilkis was gangraped even she was pregnant.
On January 21, 2008 the special trail court has sentenced 11 persons to life imprisonment in the case.
The trail court has also sentenced Somabhai Gori head constable of the limkheda Police station to three year imprisonment for framing false records. and also for not lodging Bilkis first complaint.
The CBI has also asked the court to sentence the death penalty to Jaswant Nai, Govind Nai, and Shailesh Bhatt who were charged raping Bilki Bano.
And according to the accused Bhatt was the man who killed her 3 year old child in a pre-planned attack in the wake of a bandh to protest the Godhra train burning accident.
CBI has also quoted that all three of Jaswantbai Nai, Govindbhai Nai and Radhesham Shah were main accused and have raped Bilkis, her sister and her mother infront of each other.
These factors, according to CBI constituted "aggravating factors" and demanding meriting capital punishment.
