A Bench of Justices N V Ramana and D Y Chanrachud along with Chief Justice J S Khehar issued notice to the state goverment. Senior advocate Kapil Sibal appearing for the petetioner said;

"the officer was granted bail, reinstated, promoted and rewarded despite being an accused in a murder case."

He also stated that a couple of days back three months extension has been given to the DGP.

The Bench said notice has been issued and he should wait for the response.

The Appointments Committee of cabinet of the central goverment had granted the three-month extension to Pandey, who was supposed to retire on January 31.

Pandey was heading the state crime branch when Ishrat Jahan (19) based in mumbra, Javed Sheikh alias Pranesh Palli, Amjadali Rana and Zeeshan Johar were killed in a fake police encounter on the outskirts of Ahmedabad on June 15, 2004. The Gujarat police alleged that they had terror links.

After that, an SIT constituted by the high court to investigate the case concluded that it was a fake encounter, following which the HC transferred the case to CBI.

However, Pandey was released on bail and was taken back into service in Feburary 2015 and was made the Director of the state Anti Corruption Bureau.

Last year on April 16, Pandey was appointed as the in-charge DGP of Gujarat following unexpected transfer of incumbent PC Thakur to Delhi.
